This Advanced Symposium is designed to identify and consider how to address business and legal issues that arise in a factoring business; beginning with the structuring of a deal up-front to managing a client relationship in order to limit or mitigate potential losses. Time will be spent analyzing these issues as well as other topics in an open discussion setting.

Some Discussion Topics Include:

  • Fraud Case Study: A case study of a real life factoring fraud in which the Export-Import Bank of the United States was involved. Special agent Dan Stitt, along with Mike and Jared will share the facts of the case and all investigatory tools and secrets about how the fraud was proven.
  • Participation Agreements: What do you need to look for if you are the “Lead” and what do you need to look for if you are the “Participant”?
  • New Legal Issues That Will Have An Effect on Factoring Operations and the Practical Solutions.
  • Analysis of Recent Cases Impacting Factor Liability.
  • Uniform Commercial Code: A host of Uniform Commercial Code issues to be discussed.
  • Additional Topics: There will be other topics in addition to those above, including the effect of factors doing business when you exchange electronic records and electronic signatures with clients or account debtors.
